La vacanza è un’ occasione di piacere, svago e riposo, un vero e proprio periodo di rigenerazione delle proprie energie psico-fisiche e, qualora essa venga rovinata, è giusto che il turista deluso ottenga un risarcimento.
Orbene, il Codice del Turismo, con l’art. 47 co. 1 D.lgs. n. 79/2011 prevede la possibilità di accordare al turista un risarcimento del danno da vacanza rovinata a causa dell’inadempimento dell’organizzatore, prevedendo che: “Nel caso in cui l’inadempimento o inesatta esecuzione delle prestazioni che formano oggetto del pacchetto turistico non sia di scarsa importanza ai sensi dell’articolo 1455 del codice civile, il turista può chiedere, oltre ed indipendentemente dalla risoluzione del contratto, un risarcimento del danno correlato al tempo di vacanza inutilmente trascorso ed all’irripetibilità dell’occasione perduta”.
Quando la vacanza si trasforma in un’ulteriore occasione di stress, il turista ha diritto ad ottenere il rimborso ed un ulteriore quantum economico a titolo di risarcimento per la perdita della sua occasione di piacere, svago, relax e benessere psico-fisico.
Nell’ attuale momento storico, sia per il legislatore sia per la giurisprudenza, piacere, relax e benessere psico-fisico sono beni della vita e, in quanto tali, suscettibili di tutela giuridica.
E’ bene chiarire che il turista ha diritto al riconoscimento di una duplice tutela: il rimborso del danno patrimoniale vero e proprio che consiste nella perdita economica che ha subito (ad esempio per il denaro occorso per acquistare nuovi capi di abbigliamento in seguito allo smarrimento della valigia, per il pagamento di un altro pernotto in hotel per il ritardo aereo e simili, o, per la differenza tra il valore economico del viaggio inizialmente pattuito e il valore economico del viaggio di fatto vissuto dal turista-consumatore in seguito ai disservizi incontrati) e il risarcimento del danno da vacanza rovinata come voce di danno non patrimoniale (danno biologico, morale ed esistenziale) che, di solito, non è dimostrabile nel suo esatto ammontare e, dunque, quantificato secondo equità caso per caso.
Prima del d.lg.79/2011 il turista poteva sperare di ottenere il risarcimento del danno non patrimoniale da vacanza rovinata invocando l’art. 2059 c.c. tuttavia, la norma limitava e limita espressamente la risarcibilità del danno non patrimoniale ai soli casi previsti dalla legge e, dunque, di fatto per il turista prima del 2011, era molto complesso ottenere il risarcimento per le proprie vacanze rovinate, poiché la fattispecie non era ancora tipizzata e, l’ unica possibilità di risarcimento era legata alle ipotesi in cui si configurava la lesione di un bene costituzionalmente protetto come la salute (ex art. 32 Costituzione).
Grazie al Codice del Turismo la lacuna è stata sanata ed è stata aperta piena tutela al turista deluso.
